1. Application of these conditions
The service and offers of the seller are made exclusively on the basis of these conditions of sale. The placing of an order is deemed to be an acceptance of these conditions.
2. Content of the online-offer
Paradise Film Entertainment GmbH offers adult entertainment products through their video on demand portal (VOD portal). Paradise Film Entertainment GmbH offers no guarantees concerning the actuality, correctness or completeness of the information presented. Users must assure themselves about the applicability, relevance, nature, purpose, possible side effects and long term effects and, if necessary - in individual cases and in regard to the state of health and physical condition of the user - seek independent advice regarding the suitability for the user of the information presented. Liability claims against Paradise Film Entertainment GmbH for indirect and/or direct damages of a material or spiritual kind, which have been caused through the usage or non-usage of the presented information, respectively, through the usage of defective and/or incomplete information, are categorically excluded, in as far as guilt by intent or gross negligence cannot be proven against Paradise Film Entertainment GmbH, if there is no verifiable, intended and grossly negligent default imputed. All offers are subject to confirmation and are without commitment. Paradise Film Entertainment GmbH explicitly retains the options to amend parts of the pages or the whole of the offer without prior notice and to expand, to delete or to completely cease publication, either periodically or permanently.
3. Validity of these liabilty exclusions
These liability exclusions are to be considered as a part of this internet offer. In as far as certain portions or individual formulations in these texts do not comply with the current legal position, either in part, no longer or not completely, all other elements of this document remain unaffected in their content and validity.
4. Right of use
4.1 Paradise Film Entertainment GmbH gives their customers a not permanent exclusive, temporary limited and not sub-licensable right of use of the videos for the time period of 24 hours beginning from contract conclusion
4.2 The customer has the right to use his temporary limited purchased videos in the following form: Download, save and duplicate the video files on personal hard disc and watch for an unlimited number of times for the duration of 24 hours, or watch the videos per streaming method for the duration of 24 hours.
4.3 Any other form of use is not allowed. Any other form of duplication, except the mentioned form of duplication (note 4.2) is not allowed. Also any form of commercial use of the videos is not allowed, especially the sale, distribution and public reproduction/fewing.
4.4 Any use of the videos that goes beyond the mentioned rights of use is an copyright afringement of the applicable laws and therefore forbidden.
5. Protection of minors
5.1 Closed user groups (adult entertainment offers): Content which is, according to § 4 Abs. 2 Jugendmedienstaatsvertrag – JMStV (Youth media state contract) only to be offered to adults is only available to persons over 18 years (or the age of majority in the particular country) from Paradise Film Entertainment GmbH.
a) Paradise Film Entertainment GmbH allows access only to natural, real persons whose majority is verified. The age verification check comes in form of the users registration to an authorized age verification system (AVS). This is reserved to natural, real persons.
b) The customer is liable to not help minors access the adults only content of the pages or help a person assisting a minor to access the adults only content of the pages. Especially the customers pin for the AVS check has to be taken care of that no third parties have access to it and use it. If there is any cause for assumption that thirds have knowledge about the pin, or already misused it, the customer has to change the password immediately. If Paradise Film Entertainment GmbH has reasonable suspicion that customers misuse the pin, that thirds have knowledge about the pin, or already misused it, we are authorized to block all use of adult content on the pages. The user will be informed about this.
c) All other obligations and information regarding the registration and the AVS are listed under protection of minors.
5.2 Offers that might affect the development of minors. All content offered by Paradise Film Entertainment GmbH that might affect the development of minors, we make sure that minors usually can not access any of that content. Paradise Film Entertainment GmbH reserves the right to offer such content with limited broadcasting time and to install authorized minor protection software to all of our pages and to limit acess to all the pages with an AVS check system. In the latter case the customer is bound to our AVS responsibilities.

6. Fees
The fees of our offered videos depend on the list prices of the day the order was placed. All fees are inclusive of VAT.
7. Avoidance of a sale
Once an order is placed it is basically not possible to cancel a purchase. This is because our VOD offers are downloadable content.
8. Rights and conditions of the customer
8.1 The customer has to make shure that any use of the VOD service by underage people is only with his/the customers explicit acceptance.
8.2 Personal login data should not be given to others and has to be kept in a save place where no third parties can access and abuse them. If there is any cause for assumption that thirds have knowledge about the pin, or already misused it, the customer has to change the password immediately.
8.3 Customers have to save their login data from time to time, that in case of a loss they can be rebuild with passable expenses.
9. Liability
9.1 At extensive contempt on any of the mentioned liabilities or by any propable cause of a contempt Paradise Film Entertainment GmbH is authorized to block any further use of our offered services. Paradise Film Entertainment GmbH will inform the customer about the blocking. The blocking will remain until the contempt is resolved or the customer made a plausible explanation that there will be no further contempt.
9.2 Paradise Film Entertainment GmbH is not liable for any harm which could have been avoided by maintaining the customers responsibilities.
9.3 The customer is liable for violations of rights of third parties that he caused and is responsible for, towards these third parties and immediately. At reasonable claims of third parties, due to such a violations, the customer is obligated to indemnify Paradise Film Entertainment GmbH in case he can not prove the he is not responsible for the breach of duty that caused this damage.
9.4 These obligations also apply even though the customer violates obligations that result from special contract conditions.
10. Payment options
Credit cards: To protect our customers from credit card misuse, we transact all our credit card payments with the highest safety precautions. Therefore credit card data can only be transferred via our especially protected data lines (256 Bit SSL-Coding). Our system checks the card data validity online. Credit card payments can only be handled via our customer login. To benefit from the credit card payment option the customer has to register to our customer login system.
11. Data privacy protection
We only use our customers personal data for the purposes of technical administration of our website and to fulfill our customers wishes and requirements. Only if the customer has agreed before, we will use our customers data for product related polls and marketing functions and even then only in specific personally related cases and at required degree. We will never give away our customers personal data to any third parties, only if our customers have agreed before or if we are obligated due to legal ordinance.
